The TSS visa helps employers fill skill gaps by hiring skilled workers from overseas when they can’t find suitable Australians. It targets temporary skill shortages while prioritizing Australian workers. There are stronger protections measures in place to ensure overseas workers have the same rights as Australians.
Three streams for the TSS visa:

  1. Short-term stream: for short-term positions, up to two years (or four years with an international trade obligation).
  2. Medium-term stream: for medium-term critical skills needs, up to four years, with an option for permanent residence after three years.
  3. Labour Agreement stream: for employers with a labor agreement to source skilled overseas workers for needs not met in the Australian market.

Benefit to TSS visa holders while the visa is in effect:

  • can work in Australia for their approved sponsor in their approved occupation;
  • may bring any eligible dependants with them to Australia — dependants can work and study; and
  • have no limit on the number of times they can travel in and out of Australia while the visa is valid.

Main Requirements for Employer Sponsored (Temporary Skills Shortage) Visa Simplified:

Sponsorship Application:

  • Your employer must have a lawful business and a record of hiring local workers.
  • They shouldn’t have any negative history known to the Department.
  • They need to commit to fair hiring practices.

Nomination Application:

  • Your employer must be an approved sponsor or have a labor agreement.
  • They should nominate a job from the skilled occupations list.
  • The position must be real and full-time.
  • They need to provide a job contract for you.
  • Your salary and employment conditions must meet the standards.
  • Labor market testing might be needed.
  • Discriminatory hiring is not allowed.

Visa Application:

Short-term Stream:

  • You need two years of work experience in the nominated field.
  • Your occupation must be on the short-term list.
  • You may need a skills assessment.
  • Show that you intend to stay temporarily in Australia.
  • Meet the English language requirement.

Medium-term Stream:

  • You need two years of work experience.
  • Your occupation must be on the medium-term list.
  • You may need a skills assessment.

Labour Agreement Stream:
